Swedlow & Associates

The attorneys and staff at Swedlow & Associates are dedicated to devoting the resources necessary to achieve the best possible result for their clients in litigating complex commercial cases on behalf of institutional, individual and representative clients.  Stephen A. Swedlow was named on the list of 2007 Superlawyers and was featured as such in Illinois Superlawyers and Chicago Magazine.

Swedlow & Associates is uniquely well-qualified to prosecute claims on behalf of classes of individuals ranging from consumers to shareholders.  The attorneys at Swedlow & Associates have spearheaded class action cases which have resulted in the aggregate award of billions of dollars to their clients. They have been pioneers in the pursuit of case strategies resulting in important decisions establishing legal precedents that have strengthened consumer and investor rights.

The firm is comprised of a team of highly dedicated lawyers and legal support professionals who have extensive trial experience both in state and federal courts nationwide. In addition to extensive experience in plaintiffs' class actions, the firm also has trial and arbitration experience in:  intellectual property litigation (including patents, copyrights, trademarks and trade dress - as counsel for both plaintiffs and defendants), environmental litigation, complex commercial litigation, antitrust litigation and securities.

We take pride in our intellectual capacity, the depth of our experience and the teamwork we employ in representing our clients and their interests - in the courtroom and beyond.

Swedlow & Associates' unparalleled experience representing both plaintiffs and defendants provides the firm with a valuable strategic advantage in representing plaintiffs. By possessing a full understanding of the strategies employed by corporate defendants, we have a unique ability to anticipate and negate the litigation tactics of our adversaries.

The firm's current practice areas include all aspects of complex commercial litigation.  Most recently, Stephen Swedlow and his co-counsel settled a nationwide class on behalf of pediatric Paxil and Paxil CR users for $63.8 million.  Click here for news story related to the Paxil Settlement.  See also St. Louis Post-Dispatch 11/2/06 and New York Times/GlaxoSmithKline Reaches Paxil Settlement.  The official informational site on the Paxil Settlement is located at: http://www.paxilpediatricsettlement.com/.  Mr. Swedlow also recently settled an employment-related class action on behalf of all hourly employees of Sport Chalet for $2.25 million.  Click here for a copy of the Sport Chalet Notice.  The firm continues to actively prosecute class actions in the areas of tobacco, pharmaceuticals, securities and consumer fraud in state and federal court throughout the country.

Swedlow & Associates handles complex class actions on behalf of retirement plans and their beneficiaries alleging violations of the federal Employee Retirement Income Security Act.  ERISA was enacted by Congress to prevent retirement plan fiduciaries from using their position of trust and confidence over retirement plan assets for their own benefit rather than the benefit of the plans and their participants.  ERISA requires that retirement plan fiduciaries owe the highest duties of honesty, loyalty and care to the retirement plans they serve.  Swedlow & Associates is committed to continuing its leadership in ERISA and related retirement litigation on behalf of those who have entrusted others with their hard-earned retirement savings.

Swedlow & Associates devotes a portion of its practice to toxic tort litigation, representing municipalities and water providers seeking redress from manufacturers of hazardous products and corporate polluters.  For example, Swedlow & Associates currently represents dozens of homeowners residing near the Exelon nuclear facility in Braidwood, Illinois whose property has been irreparably damaged by Exelon's unauthorized release of radioactive Tritium.  Click here to see an example of the Exelon Complaints.
